1. SUBJECT MATTER
Conditions regarding the participation at the "Pictoplasma NYC" conference , New York 2008.
The following general terms and conditions apply to the contractual
relation between the organizer (Pictoplasma) and the participant
of the conference. The terms and conditions are only available
in English. The terms and conditions do not apply to the sales
of books and other goods on out website, which are subject to
a special Terms
and Conditions of Sale - Books and Products.

3. PRICE / REGISTRATION FEE
-Early Bird Ticket: 120,-
-Regular Ticket: 170,- (sold by the venue, from July the 25th onwards)
All prices in US $.
All prices include legal VAT
4. ACKNOWLEDGEMENT OF REGISTRATION, CONFIRMATION Of PARTICIPATION,
TICKETING
Once the online registration has been received, a confirmation
of the registration will be provided to the participant`s email
address.
Once the payment has been processed, an email to confirm the booking
including a private booking code will be sent to the email address
of the participant. The participant shall print out the confirmation
email and bring it along with his ID. Ticket/s will be available
directly at the venue.
With the effective payment of the relevant ticket price the participant
has all rights described below.
5. SERVICES INCLUDED
The ticket price covers 2 days of free participation and access
to all pictoplasma NYC events incl. lectures, screenings,
exhibitions, performances, VJ presentations and parties.
6. NOT INCLUDED
Travel, accommodation, food and drinks are not included in the
price. Each participant has to defray his/her costs and additional
expenses.

7.
EXCLUSION OF LIABILITY
The organizer shall not be liable for any damage to property and
other subjects. With regards to essential obligations any negligence
leads to the liability of the organizer. The exclusion does not
apply to the liability regarding personal damage and to any damages
caused by the organizer intentively or with gross negligence.
8. PAYMENT
Early Bird tickets can be purchased by credit card via
the services of PayPal (USA) or WorldPay (UK).
9. INVOICES
The confirmation sent by email after registration and payment
is the invoice.
10. RIGHT OF REVOCATION
The participant can revoke his booking within two weeks without
indicating any reasons. The participant shall hand in his revocation
in text form (e.g., email). The term begins at the earliest when
received this instruction. The revocation is in compliance within
the term-limit once the participant has sent the revocation on
time. The participant shall direct the revocation towards the
organizer (see 2.).
In case of an effective revocation the performances received on
both sides are to be granted back, incl. drawn uses.
In case of an effective revocation payment will be refunded excluding
the costs which occur due to the chosen payment system (eg. bank
transfer costs, postage).
11. CANCELLATIONS & REFUNDS:
Not withstanding the provision regarding the right of revocation:
The organizer must be notified of any cancellations on or before
the 1st of June 2008. Payment then will be refunded minus
a 30,- $ administration fee. No refund will be paid for cancellations
after 1st of August.
12. DATA SECURITY
Datas of the participants will only be used for the purpose of
registration / participation of the pictoplasma conference. Our
data security practice is in accordance with the federal data
protection law (BDSG) as well as with the tele service data protection
law (TDDSG).
13. APPLICABLE LAW
To all disputes deriving from these terms and conditions and the
participation of the festival (regarding tickets, access etc.)
German law is applicable.
14. JURISDICTION
All disputes arising from this terms and conditions and the participation
to the conference are subject to the jurisdiction of the organizer`s
principal place of business, Berlin, Germany.
15. MISCENELLOUS
Every provision of these terms and conditions is independent and
valid independently from the validity of the other provisions.
If a provision should be invalid, it shall be replaced by a provision
which corresponds to the presumed corresponding intention of the
concerned parties. |
